Guest JMN Posted October 13, 2011 Posted October 13, 2011 What do you do where you do not have enough information to file a Form 5500 by the filing deadline? Wait and submit under DFVCP, or file incomplete with a statement?
jpod Posted October 13, 2011 Posted October 13, 2011 Pre-EFAST the answer was to file incomplete and then amend. Not being privy to the nuances of EFAST, can you even file an incomplete 5500? P.S., if by any chance you have the Hurricane Irene extension you have another 2 weeks.
shERPA Posted October 13, 2011 Posted October 13, 2011 If a client hasn't provided the info, then DVFC is the next step. And the pain of writing that check will help them remember to get the info in timely next year. Would your tax accountant prepare your 1040 for you without your W-2 information? Would YOU sign a government form under penalty of perjury, knowing the information is not correct? If you're not willing to sign it that way, you shouldn't prepare it for your client either, IMHO. I carry stuff uphill for others who get all the glory.
Guest Form5500 Posted November 1, 2011 Posted November 1, 2011 You have to wait and submit it under the DFVCP. I agree with shERPA - when a client signs the Form 5500 they are submitting it under penalty of perjury and are attesting that all the information is factual. It's not worth the civil or criminal penalties to lie.
