Guest JM123 Posted April 30, 2012 Posted April 30, 2012 If a plan in critical status with an accumulated funding deficiency goes into reorganization, does the temporary relief from the excise tax continue to apply? Or are critical and reorganization statuses exclusive?

It is my understanding that if a pension fund goes into reorganization status, there is a statutory formula that determines whether contributing employers have to put in additional contribution amounts. The protection from AFD and excise taxes for critical status plans under the PPA probably does not apply.
