Employee is considered full time, but has not worked 40 hours since being hired due to lack of work. Employee is paid on an hourly basis. Our eligibility for health insurance and our POP plan define full time as 40 hours, does anyone see how I might make a case to enroll the person in medical benefits and pre-tax it?

Our plan documents say "regularly scheduled to work". But if the person has NEVER worked a 40 hour week, that might be a tough sell to the carrier.

If your policy, and documents, state that the employee must be full-time and work 40 hours a week, then that is what you must follow. Since this person has never worked 40 hours, they are not eligible. You may want to check your policy/documents, many are now written at 32 hours per week.
