Gudgergirl Posted October 22, 2012 Posted October 22, 2012 Is it possible to amend the definition of "change in control" to increase the control % from 50 to 80? If so, would this amendment be subject to 1.409A-2(b)(6) such that the amendment would not be effective for 12 months? Any guidance is appreciated.
