Batches submitted between 12/10/2015 and 1/18/2016, will be queued for submission once the IRS FIRE site maintenance is completed. Has the IRS mentioned whther or not late filing penalties will not apply during this period? We have some that are due on 1/15/2016. Austin Powers, CPA, QPA, ERPA
david rigby Posted January 7, 2016 Posted January 7, 2016 Maybe it's just me, but reading "IRS" and "fulfillment" in the same sentence is amusing. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
Tom Poje Posted January 8, 2016 Posted January 8, 2016 I suspect if you have proof you made an attempt to file such penalties would be waived. ha ha ha. 1. you have at least 250 forms so you MUST file all of them electronically 2. we shut down FIRE for 1 month so you can't file some forms electronically 3. guess you are screwed.
My 2 cents Posted January 8, 2016 Posted January 8, 2016 The shut-down of the FIRE system was discussed here back at the end of November and the first few days of December. The IRS was apparently saying that no paper filings would be accepted and that the solution is to file before the shut-down (that people only became aware of when it was mentioned here for the first time on November 30th). So Tom, I guess your summary is pretty much on target (especially item 3)! Always check with your actuary first!
Tom Poje Posted January 8, 2016 Posted January 8, 2016 again, I suspect, as long as you have proof you attempted to file timely, I suspect any penalties would be waived. I don't see how that is much different than when a business gets shut down because of floods or hurricanes or whatever and an automatic extension is granted so try checking the box "special extension" and fill in "I tried to file timely after the client finally provided the data after much begging and pleading for months, but by then the #$%^&^@*(!@&* filing system was shut down for a month. so even tough I had the data on a timely basis the problem is at your end." I'd used 2pt font or something similar.
