Is this rule out the window now, with the disappearance of the Form 5500 C/R? As I recall it was not a creature of statute (or regulation) simply a provision in the Form 5500 C/R Instructions.

According to page 6 of the instructions for the 1999 5500 forms, the 80-120 participant rule still applies--you use the Form 5500 and instructions for the small plan where before you would have filed the 5500 C/R.

Large plans which formerly filed Form 5500 will now file Form 5500 and attach Schedule H which also requires a report of an IQPA. Small plans which formerly filed Form 5500 C/R will now file Form 5500 and attach Schedule I. Small plans which file Schedule I are not required to attach a report of an IQPA.

Do you mean that for a fully insured group medical plan you will also need to have the independent auditor report, or is that just for the pension plans? Thank you.
