Guest Alison Harrel Williams Posted October 9, 2000 Posted October 9, 2000 We have a Sec. 125 cafeteria plan with fewer than 100 participants. I realize that the IRS has not excluded cafeteria plans from filing the Form 5500 and must always file regardless of the number of participants. My question is are we required to complete Schedule I? If so, do we just show our plan assets as zero and the employee salary deferrals as contributions received and subsequently as benefits paid?
Guest nherkowitz Posted October 9, 2000 Posted October 9, 2000 If you are making the filing for the Cafeteria Plan only, you do not need to file Schedule I. This should be the case for a small plan unless there is a requirement to file the benefit plans included in the Cafeteria Plan. A Cafeteria Plan is considered a Fringe Benefit Plan, which only needs to file the Form 5500 and Schedule F. See the Form 5500 instructions on pages 3 and 8.
