Guest Paul Posted January 18, 2001 Posted January 18, 2001 There is no set limit for medical reimbursement plans under ERISA or the IRC. There are limits for dependent care plans. Having said that, the employer is at risk for the amounts under medical reimbursement plan. Therefore, the employer should set a realistic limit of the maximum reimbursement under a medical reimbursement plan. This limit should be set by seeing the maximum out of pocket under the "main" health plan and also consider if there is a dental and/or vision plan. The "bottom line" is the employer sets the limit under the medical reimbirsement plan and that limit should be realistic taking into account the other plans being maintained by the employer.
