Creating the optimal retirement plan design is a complex task and many plan features can cause unintended consequences, such as operational challenges (and failures), data collection issues, anti-cutback rule.  SECURE 2.0 further complicated the landscape by adding multiple new distribution options, long-term part-time employee rules, and new contribution types to an already long list of options.  This program will highlight plan design issues including selection of the best contribution allocation formula, the pros and potential cons of selecting various plan features and options, and how to remedy the errors that eventually occur for most plans.  

The workshop will address:

  • Plan design considerations, such as contribution formulas, eligibility conditions, LTPT employee status, compensation definitions, distribution options and more​​​​​
  • Common plan document drafting and design errors
  • Common operational and plan document failures that put plans at risk
  • Plan correction procedures, including key IRS EPCRS and DOL VFCP procedures
  • When self-correction is or is not an option.

Attendees can receive up to 400 total minutes or (8) ASPPA, (8) ERPA, and (8) NIPA continuing education credit hours.

Learning Objectives

After attending this Web seminar, you should be able to:

  • Design a retirement plan considering the benefits and risks of common plan features
  • Determine when the anti-cutback rule is or is not a factor in a plan amendment
  • Explain the latest updates for EPCRS and how they impact plan design decisions
  • List plan provisions that present administrative or operational risks for plan sponsors.
  • Compare the IRS EPCRS SCP, VCP, and Audit CAP programs and which options apply to certain failures
  • Identify the best plan design based on the needs, and abilities, of the plan sponsor.

Continuing Education

Attendees can review up to 400 total minutes or (8) ASPPA, (8) ERPA, (8) NASBA, and (8) NIPA continuing education credit hours.
