Join us for a can’t miss webinar with Jim Klein of the American Benefits Council. This program will address new and pending legislation, regulatory guidance and judicial rulings relating to employee benefits laws and will provide insight on how the November 2024 election results may play into the future of benefits law.

The Presentation will address:

  • The current political and legislative environment and how the forthcoming elections will change the path for health, retirement and paid leave public policy
  • The range of legislative, regulatory and judicial developments affecting employee benefit plans.  These will include the efforts at both the state and federal level to advance legislation that would erode ERISA’s federal preemption standard.
  • A range of cases pending in the federal courts that are pursuing novel theories for plan sponsor and service provider liability under ERISA. 
  • The pending litigation regarding the U.S. Preventive Services Task Force requirements that are being challenged on Constitutional grounds.
  • Efforts to persuade the U.S. Department of Labor to intervene or provide amicus brief support in employee benefits cases where plaintiffs have failed to meet DOL’s own pleading standards.
  • The range of regulatory activity (e.g. fiduciary definition, mental health parity, SECURE 2.0 regulatory guidance, etc.) that either will have recently been issued or are expected in the near future as the Executive branch agencies seek to finalize rulemaking in time to avoid potential nullification of rules early next year under the Congressional Review Act.
  • Federal responses to the myriad state and local paid leave laws.
  • Status of ESG guidance as it relates to employee benefit plans.
  • The opportunities to see progress on a number of health policy matters including greater cost transparency for Pharmacy Benefit Management companies, and site-neutral payment reform
