Many practitioners wrongly assume that being in a controlled group means all employees of all group members must be covered by a plan any member maintains. Not true. A plan can be limited to the employees of one member, but the plan must still pass coverage and nondiscrimination. And that’s where many practitioners run into problems. How do you test a plan of related employers for coverage? If the plan requires use of the general nondiscrimination test, how do you handle it in a controlled group? What are the design alternatives for related employers?
