The Department of Labor (the “DOL”) is actively auditing employers and their group health plans for compliance with the Mental Health Parity and Addiction Equity Act (the “Act”), and health plan participants are bringing lawsuits under the Act.

In particular, we will discuss the ins and outs of the parity rules for group health plans under the Act, including the most recent agency guidance. We will focus on specific plan provisions that raise issues under the Act and the steps employers can take now to prepare for a DOL audit and participant inquiries.
