The Supreme Court returns October 7th for its 2019-2020 Term, and the Court currently has three ERISA cases on its docket -- Intel Corp. Investment Policy Committee v. Sulyma (actual knowledge for purposes of triggering statute of limitations), Retirement Plans Committee of IBM v. Jander (pleading standards under Dudenhoeffer), and Thole v. U.S. Bank, N.A. (standing). In addition, Texas v. United States, challenging the constitutionality of the Affordable Care Act, may reach the Court before the end of its Term.
