The SECURE Act and Spending Bills – Advice for Plan Sponsors and Service Providers

Please join us for the first installment of our webinar series designed to summarize the major provisions of the Setting Every Community Up to for Retirement Enhancement Act of 2019 (the “SECURE Act”), the largest package of retirement tax legislation to be enacted in more than a decade. Many provisions of the SECURE Act became effective as of January 1, 2020 and require significant changes to retirement plan design and operation. In addition, the SECURE Act was part of the Further Consolidated Appropriations Act of 2020 (the “Spending Bills”), which included changes that impact health and welfare plans.

This webinar, taking place February 13, 2020 at 1:00 PM (ET), will educate retirement plan sponsors and service providers of changes and considerations that should be taken regarding the SECURE Act and Spending Bills. Dannae Delano and Dan Brandenburg will summarize the major provisions of the SECURE Act and Spending Bills that are designed to largely combat three areas that are lacking in Americans’ retirement readiness: access to retirement savings, saving for retirement, and guaranteed income production in retirement. Specifically, this program will address the following:

  • Part-time employee participation in 401(k) Plans
  • Changes to Safe Harbor 401(k) Plans
  • In-Service Withdrawal Options for Birth and Adoption Expenses
  • Disaster Relief
  • Lifetime Income Disclosures and Investment Options
  • Lifetime and Post-Death Required Minimum Distributions
  • 5500 Changes and Increased Penalties
  • The Expanded Small Employer Tax Credit
  • Changes Affecting Defined Benefit Plans
  • Changes Affecting Health and Welfare Plans

Dannae and Dan will discuss each of these major changes and provide advice regarding the considerations that should be taken regarding these changes from either a plan sponsor or a service provider perspective.

Webinar Objectives

  • Plan sponsors will be able to identify changes that need to be made to their 401(k), defined benefit, and health and welfare plans
  • Plan service providers will be able to identify the implementation issues that will need to be addressed to ensure SECURE Act compliance
  • Plan sponsors will be able to consider additional plan options that may be a good fit for them
  • Plan service providers and plan sponsors will be able to identify the plan documents that will need amending and updating to ensure compliance
  • Plan sponsors will learn where to find written representation regarding financial capabilities of current and prospective annuity providers
  • Plan service providers will understand their needs to administer special eligibility and vesting provisions for part-time workers
  • Plan sponsors and service providers will be reminded that reporting requirement failures can carry substantial monetary penalties
