Plan Mergers & Terminations: When We Need to Say Goodbye to a Plan

American Society of Pension Professionals & Actuaries [ASPPA]

Apr. 1, 2020
Recorded Online

Winding down a plan can be a perplexing and difficult task.  The law relating to plan terminations and partial plan terminations can be confusing.  What is the difference between a terminated plan and a frozen plan?  Are there best practices relating to merging plans?

This session will discuss the ins-and-outs of a plan’s “twilight time” and how to handle some of the complexities that can arise when you must say goodbye to a plan.

Learning Objectives:

  • Identify the difference between plan freeze and plan termination.
  • Determine when and how distributions must be taken.
  • What are the limitations on termination a PBGC-covered plan and how do I overcome these?
  • Must I file for an IRS determination letter?  Yes or no.
  • Coordinating the termination process.

Speaker:  Ilene H. Ferenczy, Esq., CPC, APA, Managing Partner, Ferenczy Benefits Law Center
