Employee benefit plan lawyers face many complex ethical challenges when advising employers and plan sponsors. Using interactive scenarios, this program will explore various ethical issues that may be encountered by employee benefit plan lawyers, including identification of the client, establishing the scope of representation, conflicts of interest, and protection of confidential information. The panel will discuss the principles and effects of legal ethics and pertinent sections of the Model Rules of Professional Conduct that may apply to these situations, including Rules 1.1 (competence), 1.2 (scope of representation), 1.4 (communication), 1.6 (confidentiality), 1.7 (conflict of interest), and 1.15 (safekeeping of client property).
