An interactive discussion between benefits attorneys, benefits litigators, CPAs and vendors, the first portion of the program will focus on fiduciary responsibilities for vendors to accurately perform their responsibilities. The second portion of the program will addressthe new audit standards that are applicable for the 2020 Plan Year.

The first portion of the program will focus on fiduciary responsibilities for vendors to accurately perform their responsibilities. Who is liable when administrative errors occur in recordkeeping Section 401(k) Plans? Is the filing of a Group Voluntary Compliance Application by a vendor adequate to account for administrative and system errors? Should there be liability beyond the scope of Service Agreements, which tend to be one-sided?

The second portion of the Program will focus on the fiduciary obligation of Plan Sponsors to select auditors, to review all applicable reports for recordkeepers, custodians, payroll companies and other sub-service organizations as an opportunity to perform fiduciary due diligence on these service providers, an introduction of the new audit requirements of SAS 136 for early adopters with 2020 filings and required for 2021, and will introduce the new SOC 2 & 3 audits that will provide added assessment of vendors data protection and security issues with which attorneys and Plan Sponsors should become familiar.
