All attorneys face ethical conundrums, but each practice area comes with its own unique circumstances particular to their type of work and clients. Rather than listening to someone explain how to handle a situation that is not relevant to you, take this opportunity to hear about the issues that you – an employee benefits practitioner -- actually deal with in your daily practice!

In this webcast, the faculty will examine ethical situations in representing employee benefit plans and plan sponsors, fiduciaries, trustees, and plan service providers. Our faculty -- two highly experienced ERISA litigators -- will discuss issues implicated by the representation of multiple parties in employee benefit plan transactional work as well as litigation, providing guidance as to the most relevant Model Rules relating to joint representations. Particular emphasis will be placed on the fiduciary exception to the attorney-client privilege.

What You Will Learn
This one hour program will focus on real world ethical scenarios faced by employee benefits lawyers and the Model Rules of Professional Conduct that apply to those scenarios, including:

  • Conflicts of interest among current clients (Rule 1.7)
  • Confidentiality of information (Rule 1.6)
  • Imputation of conflicts of interest (Rule 1.10)
  • Retention of an organization (Rule 1.13)
  • The definitions of “informed consent” and “confirmed in writing” (Rule 1.0)
