On November 3, 2023, the Department of Labor (“DOL”) proposed a new definition to determine when someone is acting as an investment advice fiduciary under ERISA. At the same time, they also proposed changes to a number of exemptions. This is the latest proposal in the saga that began in 2010 when DOL initially began attempting to rewrite the fiduciary standards. DOL finalized a rule in 2016, only for courts to strike it down in 2018. DOL again attempted to expand the scope of its rules in 2020, only again to be thwarted by courts in 2023. We will describe the new proposal and forecast where it is headed. 

The program will cover:

  • History of fiduciary saga
  • Overview of new rule
  • Discussion of DOL’s process and comments
  • Prediction on when finalized and if there will be litigation.
