Spouse and Rail Worker Have Been Separated for 20 Years

Question 1154: My husband and I have been separated for about 20 years but neither ever filed for divorce. Am I still able to collect Railroad Retirement benefits? I am 61 and he is 63.
Answer: You are still married and so you are eligible for a Spouse Annuity.
If your husband is retired and had at least 30 years of rail service, you are eligible now.
Otherwise, you will be eligible when you are 62.
