Stop, Look & Listen: Railroad Retirement Benefits Q&A

Answers are provided by Robert S. Kaufman

Divorced Spouse Needs Legal Services

(Posted August 7, 2014)

Question 1165: By decree from 1987, our 14-year marriage was dissolved. A formula was established based on total months of marriage under Railroad Retirement divided by the total number of working months. My ex-husband is on his third wife, who objects to my share. I recently received a message from my ex-husband telling me to contact my lawyer and have the agreement rewritten to comply with RRB regulations. He has now worked for more than 40 years and is age 63. Must I do this?

Answer: You need to consult with a Divorce Attorney to ensure that you will receive the amount of Tier 2 awarded in your final divorce decree. The local Bar Association can furnish a list of qualified attorneys.
