Question 732: What percentage of divorced rail spouses who receive a divorced spouse benefit also get part of their former spouse's Tier 2? Is this fair to rail workers?
Answer: I'm not aware that the RRB keeps stats on that catagory.
Remember, a Divorced Spouse Annuity is provided by law.
The division of Tier 2 is based on the fact that "pensions" are considered to be property and therefore are subject to division in the property settlement aspect of a divorce.
