Qualified Domestic Relations Order (QDRO)
(Posted May 22, 2010)
Question 752: I'm in the process of divorcing my husband who has worked for the railroad for more than 25 years.
My lawyer wants to do an order called "Order Dividing Railroad Retirement Benefits," but everything I have read talks about a "QDRO." Which should I use?
Answer: I'm not an attorney but I think your attorney was referring to using a "QDRO" when he said he would do an order dividing your husband's Railroad Retirement. That's the legal document required to divide Tier 2 benefits between you and your husband.
