Partition Tier 2 Payments To Divorced Spouse Continue After Rail Worker's Death

Question 845: If the railroad worker dies before the former spouse, what happens to the portion of Tier 2 that she receives? Will she continue to receive it?
Answer: Originally, Tier 2 Payments to a former spouse ended when the rail worker died. The Railroad Retirement Act was amended a few years ago -- payments now are continued.
