(Posted January 4, 2012)
Question 847: In regards to Q&A 845, what about the "reverse" situation -- What if the former spouse dies? Does that portion of a worker's Tier 2 benefit awarded to the former spouse in the divorce go back to the worker and so as to increase the Tier 2 benefit?
The partition of a worker's Tier 2 is terminated if the former spouse dies. The worker's Tier 2 benefit is restored to the full amount after the former spouse's death.
