Answers are provided by Robert S. Kaufman

Length Of Marriage Required for Benefits

(Posted May 12, 2012)

Question 876: How long do my wife and I need to be married in order for her to receive benefits?

Answer: The duration of marriage requirement is different for a spouse and a widow(er).

The spouse and the rail worker need to be married for at least one full year before spouse benefit payments can begin.

If the rail worker is deceased, the duration of marriage requirement for a widow(er)'s benefit is 9 months.
