Non-Vested Rail Worker Is Getting Divorced

Question 963: I have been working for the railroad for 2-1/2 years. I am getting a divorce. We have been married 17 years. Is she entitled to any railroad retirement benefits?
Answer: You are not yet vested in Railroad Retirement. I would consult with an attorney about your future Railroad Retirement benefits assuming you will become vested, to see if your wife would be entitled to any portion of your Tier 2.
