Unclear from DFVC FAQ: when paying DFVC fee electronically online, is there a requirement to also submit pdf's of the applicable 5500's electronically, mail in paper forms, or no such requirement?

Also, no response from hotline so asking the question here.

I take the following to mean that online payment is just that, payment, and nothing else is required except the regular filing.

Remember, if you pay online, you need to electronically submit the original filings to EFAST2 to participate in the DFVCP. Acceptance of the online payment does not constitute acceptance to the DFVCP.

A few years ago, we filed Form 5500's for 2007 through 2014 in Oct 2015.  Process was to file all Form 5500's through EFAST first, then use the DFVCP Penalty Calculator online to file the DFVCP fee.  The penalty calculator asked for the date that the late Form 5500's were filed through EFAST.

Does anyone know what happens after applying for DFVCP (payment and forms submitted)? Will IRS confirm that penalty was waived or will DOL at least confirm that the application was successful?

Interestingly in our case, I don't think the plan sponsor got penalty letters from the IRS for non-filing... or last we weren't told.  Also, we never heard from the IRS or DOL after filing all late 5500's and DFVCP in 2015.  Plan terminated at the end of 2016, and the final Form 5500 was filed in 2017.  Still no communication from the IRS and DOL...

It's been a while but I don't think there is confirmation.  I think the check being cashed or ACH is your confirmation.  I guess if there was an error they might contact you but you'd have to try hard to make an error.

If a notice with a penalty has been issued, they are supposed to issue a new notice with a $0 balance if it is abated or removed.  That process used to take a while (months) during normal conditions so who knows.  you can always call them and verify verbally after a few weeks.
