Excerpt: At its heart, the case presents one fundamental question, though cloaked - like many ERISA cases - in a wide ranging and complicated documentary, factual, and judicial history.... Here though, the key issue is one of deference, and whether a court must continue to apply deferential review to a plan administrator's interpretation of a plan when the court has already rejected the administrator's earlier interpretation as being arbitrary and capricious.
