[The great majority of the courts that have addressed the issue] have concluded that the fiduciary exception to the attorney-client privilege allows plan participants and the Secretary of Labor to obtain testimony ordocuments relating to confidential communications between plan fiduciaries and their lawyers regarding plan administration.
