"The interim final rule ... identifies any employee's receipt of tax sharing or a cost-sharing reduction pursuant to PPACA as entitling that employee to whistleblower protection under FLSA.... Notably, there is no time limit defined in the regulations regarding this point, making it conceivable that once an employee receives the cost sharing subsidy ... he or she is by virtue of that receipt in a protected class in perpetuity. Indeed, this literal reading of the statute and regulations could afford such an employee with whistleblower protection throughout his or her lifetime, across multiple employers."
