U.S. District Court for the District of Massachusetts Sept. 24, 2013 "Aetna determines whether claims for short-term disability benefits satisfy the terms of the Plan and Policy and also is liable for benefits payable under the Plan.... Therefore, a structural conflict of interest exists. However, a decision to award at least some benefits rather than deny benefits entirely 'manifest[s] an approach demonstrating an unbiased interest that favor[s the claim applicant], making the conflict factor "less important (perhaps to the vanishing point)."'"
