As the 'arbitrarily-determined' cutover date approaches, the plan sponsor and the plan's retirement committee or fiduciaries are forced to either concede or compromise on ... [the] exact basis upon which and the exact amount the record-keeper is being paid.... [and the] terms and conditions of the administrative services agreement (ASA)."
