Text of IRS Proposed Regs: Deductibility of Qualified Transportation Fringe, Transportation and Commuting Expenses under Section 274

64 pages. "This document contains proposed regulations to implement legislative changes to section 274 of the Internal Revenue Code ... Specifically, the proposed regulations address the elimination of the deduction under section 274 for expenses related to certain transportation and commuting benefits provided by employers to their employees in taxable years beginning after December 31, 2017. The proposed regulations provide guidance to determine the amount of such expenses that is nondeductible and apply certain exceptions under section 274(e) that may allow such expenses to be deductible."

40 pages. "Since the tool's 2018 update, DOL issued additional guidance on MHPAEA, hosted a roundtable discussion with stakeholders on MHPAEA compliance, and continued its enforcement efforts. In addition, DOL frequently coordinated with other Federal and State agencies and State insurance regulators to ensure consistent interpretation of MHPAEA, provision of education, and improved enforcement of parity requirements. In coordination with the Departments of HHS and the Treasury, DOL is proposing to issue this updated 2020 MHPAEA Self-Compliance Tool with certain amendments. DOL Issues Proposed 2020 Self-Compliance Tool to Further Mental Health and Substance Use Disorder Parity Compliance

"The tool will enable group health plans, plan sponsors, plan administrators, health insurance issuers and other parties [to] determine whether a group health plan or a health insurance issuer complies with the provisions in [both the Mental Health Parity and Addiction Equity Act (MHPAEA) and ERISA]. EBSA is requesting public comments on the ... proposed revisions by July 24, 2020.... After considering all feedback, the Department will issue a Final 2020 MHPAEA Self-Compliance Tool with any necessary clarifications. The Department last issued the [tool] in 2018."
