"[T]he DOL has entered into a number of 'process agreements' settling specific cases and investigations it has brought against ESOP trustees. These process agreements set out steps those trustees are required to take when selecting a valuation advisor and reviewing that advisor's valuation report."

"[T]wo competing visions for multiemployer pension reform legislation have been introduced in Congress.... These bills have some common characteristics, but also many differences.... It is possible that a revised version of the recent bills, and in particular the Scott-Neal Act, could be included in COVID-related stimulus legislation currently being negotiated in Congress."

"A plan allows participants to self-direct investments in individual brokerage accounts. This is NOT an investment platform, but the total asset balance in each participant's account can be obtained each day online or with a phone call as the funds are publicly traded. I believe this makes it a daily valued plan (must be indicated in plan doc) and it can be 404(c) compliant if meeting other requirements. The money type balances are only determined on annual basis by yours truly (TPA). Does this change it from being a daily val plan to an annual valuation plan that cannot be 404(c) compliant?"

"I am talking with an attorney who has a practice with no employees, just him. He has a 'dba' business name and he puts all revenue through the dba which he reports as a sole proprietorship on his tax return. He has no EIN and seems reluctant to create one. He wants to start a 401k for himself. Can he do that without an EIN?"
