If it is advantagous to both the employer and the employee, can a Medicare eligible employee move off of a group plan to a Medicare supplement plan that is paid for by the employer. In this case the group has a high deductible and the 65 yo persons rate is extremely high. It makes more sense to put the 65 yo on a Plan J Medicare supplement paid for by the employer and then also buy a Part D Rx benefit. Can this be done legally?

If an employer has employees who work beyond age 65 and are eligible for Medicare can the employee move off of the group plan and onto a Medicare supplement and have it paid for by the employer. In this case the group plan has a very high deductible and the cost for the 65 yo person is very high. If both agree, can the employee obtain a Plan J Medicare supplement and a Part D Rx plan and have the employer pay for it. It seems that both parties win. Can this be done legally?
jpod Posted January 10, 2008 Posted January 10, 2008 This may be illegal under Medicare's "working aged" rules under its Secondary Payer provisions. There are a few factors to consider. If you are going this alone without the benefit of a knowledgeable attorney or consultant, I suggest you start by going to the CMS website and looking at the Secondary Payer/working aged rules.

Guest KAL Posted May 27, 2008 Posted May 27, 2008 Hello Transferring your Medicare eligible retirees to different plan called Medicare Advantage, which may have lower costs for retirees or over age 65, is doable. If you allow or allocate so much money to offset costs to your retirees under your current plan, you can offer them a different a plan. Ford Motor company and numerous other manufacturing companies have either implemented or are reviewing their current plans to see how they can offer them a lower cost plan and offering them an annual amount to offset the costs of going to the lower cost provider.
