  2. without trying to research, does the change even make a difference? according to the ERISA Outline book about the only differences between 3401(a) and W-2 are 1. odd items like non-cash comp for ag labor is excluded from 3401(a) but included in w-2 and 2. excess group term life insurance is included in W-2 but not in 3401(a)

There are fines and penalties for hiring or continuing to employ persons who are not authorized to work in the USA, for failing to comply with I-9 regulations, etc. Similarly, there are fines and penalties for discriminating against someone who is authorized in the USA. https://www.uscis.gov/i-9-central/penalties So, usually the best option for the employer is not to dilly dally in resolving the status of the employees who have an SSN mismatch.

  6. By all means, if you can borrow at 5.5% and get a guaranteed return of 10%, do it. There are no risks: - lose your job? No risk there. - default of your family member's business? No risk there. - mis-estimate of your 10% return assumption? No risk there. - loss of diversification in your investments? No risk there. - risk of family alienation? No risk there.

  7. Agreed. If you have the wrong SSN on file, then now would be a better time than later to correct the FICA and income tax withholding payments that have gone to the wrong SSN. If the SSN is not the employee's, then other steps may be in order, perhaps through e-verify. In any case, I wouldn't sit around waiting for additional IRS notices.

  8. If you're just looking for opinions mine would be to contact the employee and try to correct the problem before receiving an IRS penalty notice.
