  3. Depends on the plan document and the form of the election. If the initial election was to pay upon separation, and due to specified employee status the 6 month delay is imposed, then a subsequent distribution should be separation + 5 years. The 6 month delay is satisfied since 5 years is longer than 6 months. I know I've seen this commented on somewhere but I can't find it offhand. If the form of the initial election is 6 months after separation, then the subsequent distribution election could not commence earlier than 5.5 years after separation.

I haven't actually seen a situation where the IRS nailed someone for a "late" safe harbor notice, but then, we always get ours out on time - although I can't guarantee that the clients actually do the same! Has anyone seen, or do you know of, a "real life" situation where they stuck it to someone on this? I'd like to think they would be generally reasonable - particularly if the safe harbor is the 3% nonelective. Just curious...

I'm not sure which version of Excel is being used, but the Office 365 version contains the IFS function that checks whether one or more conditions are met and returns a value that corresponds to the first TRUE condition. The syntax is: IFS(logical_test1,value_if_true1,[logical_test2,value_if_true2],[logical_test3,value_if_true3],...) Logical_test1 is required, as is value_if_true1. You can nest up to 127 different conditions.

  8. As far as I know the RMD is still required and does not require any spousal consent. You can let both parties know it was made and they can negotiate it into the settlement as to what both parties ultimately get.

  10. ah, not quite the same as what I heard A Englishman, a Scotsman, and an Irishman walk into a pub. They proceed to each buy a pint of Guinness.Just as they were about to enjoy their creamy beverage three flies landed in each of their pints, and were stuck in the thick head. The Englishman pushed his beer away from him in disgust. The Scotsman fished the offending fly out of his beer and continued drinking it as if nothing had happened. The Irishman too, picked the fly out of his drink, held it out over the beer and then started yelling, "SPIT IT OUT, SPIT IT OUT YOU #$%&*@!!!"
