    Online courses for EA-1A Exam?

    I'm planning to take the EA-1A Exam in May 2003 and was just wondering if there is any kind of online course or study program to take since travelling to (or paying for) courses is not an easy possibility for me.

    Gateway and Top Heavy

    Sorry if this one has been beaten to death but...

    I have a cross-tested profit sharing plan, plan year end is October 31, 2002. There is one participant who worked less than 1000 hours and will be getting a top heavy contribution. It is my understanding that for this plan year I don't have to worry about the gateway.

    But...

    In looking forward to the next plan year, would I need to raise the participant's 3% top heavy contribution to 5% to meet the gateway?

    VCT for Universal Availability Failure

    Anyone have experience in correcting universal availability failures through VCT? Does IRS require correction similar to the standard Appendix B correction for the exclusion of eligible employees from a 401(k) plan (i.e., require an employer contribution equal to the average contribution by participating employees)?     Can a Professional Employer Organization (Employee leasing company) offer a cafeteria plan to its leased employees as long as it "has the right to direct and control the worker", pays the benefits of the leased employee, and withholds the medicare, social security, and FUTA requirements?


    ADP and Prior Year Compensation with a Multiple Employer Plan

    Hello:

    We currently have a Multiple Employer Plan and are a PEO. I have a client who states that she was provided the option to use prior or current year compensation for ADP testing. Under our MEP, we only allow for prior year. I understand that most PEO's with MEP's have used prior year as a default, however, I'm wondering if this is a regulation that we have to abide by?

    Can anyone help cite a reg that would prove that MEP's are required to use prior year compensation for purposes of ADP testing?

    Is pregnancy considered a pre existing condition in short term disabil

    I am an expectant mother. My company doesn't have maternity leave, and I just recently found out that I won't be able to be covered under the short term disability because it is considered a pre existing condition. I found out I was pregnant August 31,2002 and my effective date was September 1,2002. I would like to know if this is true because I was also told that pregnancy was the only thing that wasn't considered a pre existing. Also when I signed the papers electing to get the insurance that date was August 12,2002 and at that point I was unaware that I was pregnant. Any information is helpful :confused:


    NUA and Lump Sum distributions

    Can a full distribution taken after a new triggering event qualify as a lump sum distribution? I took an inservice distribution from my 401k plan three years ago and now I have retired. A friend of mine told me that I can still do NUA on my company stock because I now have had a triggering event occur and it would be considered a lump sum. Is this true?


    Defined Benefit Plans

    A participant in a plan had an NRD of 8/1/99. The participant continued working until 10/31/00. Now the participant wants a distribution. I know how to figure the accrued benefit, but am having trouble deciding how to figure the lump sum distribution. Is the APR used at age 65 or at his current age? I researced my reference material and can't find anything, anywhere about it. Help.


    Out of the PEO

    I have an employer who was part of a PEO. They were a non-elective safe harbor 401(k) plan with the PEO. The plan year was 01-01 to 12-31.

    They left the PEO and started a new plan effective 09-01-02. They are going to transfer the assets from the PEO plan to the new plan.

    For the safe harbor non-elective, wouldn't the 3% non-elective contribution be based on compensation for the full year 2002?

    They also are using New Comp. and want to make a 2002 profit sharing allocation. I'm thinking they can only recognize compensaiton for the period 09-01-2002 thru 12-31-02 as the new plan is set up this way. When testing the New Comp I also assume I can only use the safe harbor non-elective for the period 09-01-02 to 12-31-02 as the offset to the New Comp.

    Is my thinking correct or am I missing something?


    Dependent Care Reimbursement

    We have an employee who enrolled in the Flexible Spending Account - electing DEpendent Coverage expenses in the amount of $900. On November 18, 2002 had a change in family status a "birth of a child". He is requesting an increase to his Dependent CAre account for the month of DEcember in the amount of $3,500.00. He wants to submitt dependent care expenses that he incurred during the year for his first child.

    Is this allowed?


    Change of valuation date

    I am considering changing the valuation date for a DB plan from Beginning of Year to End of Year. There have been no changes since the plan's inception in 1999. Does this meet the automatic approval for funding method changes or must we apply for approval?? Thanks.

    6621(A) Underpayment

    Where can I find the most recent underpayment interest rates. We're doing a correction of late deposit of participant deferrals and we may need to credit earnings based on this rate, as described in the DOL's VFC program.

    Freezing a Money Purchase Plan

    Is there a timeframe in which all assets must be paid out from a frozen money purchase plan or can it exist until the time the Trustees decide to terminate the plan? The document is being kept up to date, a 5500 is filed every year, etc.

    We are restating a plan which is a 401k profit sharing plan. In reviewing material from the prior TPA there is an interesting twist to the allocation formula for non-elective contributions. The language references both new comparability and integrated formulas with a footnote stating "the annual Employer nonelective contribution will be allocated in the manner specified in either method 1 (integrated) or method 2 (cross test) whichever method produces the highest allocation rate for the HCE with the highest compensation. There is no individual determination letter received by the IRS for the plan. Is this permissible and if so, how? Thanks!

    If you take a distribution from a Roth Contribution IRA to fund qualified higher education for a child and you are younger than 59.5, are the earnings on the Roth taxable? I understand the 10% penalty is waived.


    WHCRA - lymphedema limitations?

    Can an insured health plan limit physical therapy visits connected with early lymphedema after a mastectomy?

    The plan limits physical therapy visits to 20 per year. Is this allowed to apply to PT for lymphedema?

    I see that WHCRA allows for the plan to apply deductibles and coinsurance, but appears to be silent on other restrictions/limitations.
