  1. Recently we have run into a participant who does not believe she is eligible for benefits from the pension fund. After our review, we believe she is vested. However, we are in receipt of a letter from the participant stating she will not fill out any paperwork and does not believe she is eligible for a pension. Under the terms of the plan, participants are required to make an application for benefits. Additionally, the participant has requested that the pension fund office cease sending her letters and calling her regarding her application (or lack thereof). My initial thoughts are that if the participant does not want to make an application, there is no requirement that the NEED to apply.
  2. Hello, we are looking at terminating a multiemployer employee benefit plan that provides vacation benefits to the participants. Contributions are made through payroll deduction by the participant's employer. I can find plenty of info from the IRS relating to the termination of a retirement plan, but little to nothing on welfare benefit plans. Can anyone provide guidance? I am assuming we will need to: 1. Amend the plan to state a termination date 2. Ensure all assets of the plan are distributed properly 3. Maybe file a Form 5300? 4. File a final Form 5500
  3. Our firm serves as counsel to the local union and the associated pension fund. The union asked the pension fund staff for mailing labels (name and address). The union intends to give the information to a third-party so that participants will be mailed information (unrelated). Issues?
