  1. We've had this happen in the past and it's so frustrating because the client gets the impression we did something wrong. I've handled it by having a standard written reply faxed to the IRS along with a copy of the extension request. It's worked every time.
  2. A fiscal year filer's report was due 10/31. Our office submits on the client's behalf and the client signed and returned the form timely, the actual submission took place after 10/31. No penalty notices have been received. Is it possible to submit it again using DFVCP?
  3. I've recently received the same for a couple clients and in each case the plan had become an owner only plan and filed 5500-EZ. Although I had a client come to us several years ago after receiving a similar email, it is more of a "friendly reminder" rather than a formal notice. Before that, I'd never know the DOL to email anyone.
  4. I had a project like this last year and spoke with someone at the DOL about it and was instructed to file all missing years, but be certain the last 3 were meticulous.
  5. We're doing a VCP filing for a client and I have a copy of the adoption agreement, but need to locate a copy of the Approval letter for the Legg Mason Wood Walker, Inc. Standardized Profit Sharing Plan & Trust #03-002. Any idea where to dig it up? - I've tried the advisor's office, Legg Mason and a call to Citibank. I wanted to avoid using this particular adoption agreement because it wasn't dated, but it looks like I'm going to have to do that and hope for the best. Anyone else not be able to locate an approval letter from a large firm like this that obviously had one? How did you handle it?
