  1. If neither the participant or alternate payee have legel representation, then is it ok that the QDRO is not signed by an attorney? Is it ok that the DRO is just signed by the court and approved by the Plan to become a QDRO?
  2. Jim, It should work as long as Relius is coded correctly and you have the census more frequently then the entry dates. I had a large Plan with eligibility of 250 hours in 3 months with quarterly entry with the exception for no more then 1 yos. I was receiving the census quarterly. They system coded everyone correctly. Did you try contacting Corbel support? They should be able to help you.
  3. Mike, By no exclusions, I meant the 6 months, 21, 17.5 hrs/wk, etc... do not apply in this example. My question is the count for the top paid group to determine the HCEs for the 2007 Plan year. Is it 200 (number of employees on 12/31/06) x .20 = 40 -or- Is it 230 (number of employees on 12/31/07) x .20 = 46 I believe you refer to the lookback year (2006) and use the 200 number to determine the count for the top paid group.
  4. This should be an easy one to answer. For a 2007 calendar Plan year, how do you determine the number of employees in the top paid group for determining the number of HCEs? Say there are 200 employees on 12/31/2006. There are 230 employees on 12/31/2007. Assume there are no exclusions, no owners, and everyone makes over $150,000. Do you take the 200 times 20% or 230 times 20%?

    Thanks. That is how I read it too, but I wasn't sure if that just referred to a computer generated signature or a copy of the original signature as well.

    Will the EBSA accept a scanned version of the schedule B or do they require the original signature from the actuary?
  8. An employee works a year of service (12 months/1000 hrs) and becomes a participant on January 1, 2001. The new participant defers in the company's 401(k) plan for 2001, but only worked 500 hours. In 2002, the participant will only work 500 hours. Is the participant still eligible to participate in the 401(k) plan??
