  1. A participant takes an RMD in 2022 and dies later that year. The spousal beneficiary is now (in 2023) doing a rollover of the benefit into a regular IRA. Does a 2023 RMD need to be distributed to the spouse prior to the rollover?
  2. If a business owner legally disowns and/or disinherits his adult son, would his son still be considered a Highly Compensated Employee? The son has no direct ownership of the company and is well under the compensation threshold.
  3. Has anyone heard of an automatic extension of 5500s for deadlines falling between Apirl 1 - July 15, 2020? This article from ASPPA states that there is https://www.asppa.org/news/browse-topics/irs-5500-extension-comes-short , but when our office called the IRS for guidance, they denied any knowledge of such automatic extension.
  4. An ESOP Plan is in termination. All of the assets have been distributed except for the owners, who have chosen to take their distribution in installments over 5 years. Our understanding is that the Plan will need to file a Form 5500 each year until the assets are zero, but their attorney disagrees. I have not been able to find anything that says otherwise.
