  1. My client intends that vesting service starts on participation date, not hire date. I referenced the plan document which specifies YOS starting with employment date, however, I cannot find anything that specifically states that participant date cannot be the start date for vesting. Any ideas?
  2. Employer exceeded the 25% limit for the employer contribution. Does the 10% excise tax on the overage apply only if they have filed the corporate tax that includes the full deduction?
  3. Larry is correct. For DC allocation purposes use Box 3 or Box 5 Medicare Wages. Box 1 excludes taxable fringe benefits. I learned the hard way on this one....
  4. $6,000 is the catch-up, but I cannot seem to wrap my head around deferring on $0 comp. any thoughts or regs? I sure appreciate any help.
  5. I have a solo 401(k) participant that has $0 Schedule C compensation and is age 55. Is the allowable deferral $0 or $6,000? I cannot seem to find anything on this. Thanks!!
