My control group is two employers and they would like to run them with separate plans. I understand that if they don't pass coverage, I have to test do the ADP/ACP test. They both have different types of plans:
1. Safe Harbor with basic match and 1/anniversary
2. Discretionary match - with 1000 hours requirement 7/1 anniversary
How would I test the ADP/ACP test with them having different anniversaries? Would I follow with the 7/1 plan since they are not Safe Harbor and if they fail, then refunds would be necessary even to the HCE the participant belonged to the Safe Harbor plan?
