Even with a discretionary contribution, you must have a definite allocation formula. That is why the plan would have to be amended to adopt such a program.

There may not be a problem. I used it last year to file a late 5500EZ, received two such letters stating that they were researching before ultimately receiving a letter acknowledging the filing and payment and advising that no further action needed to be taken.
