  1. My company provides health insurance for all employees. We have several employees who have declined our insurance but, have elected coverage on their spouse's group health plan due to better coverage options. Are we able to reimburse the spouse's employer directly for this coverage as it is a group health coverage, not individual coverage?
  2. Our company was cancelled by our health insurance provider, for lack of participation. Only about 45% of the employees took advantage of the insurance. Some of the people are able to pick up coverage under a spouse's plan, and some have even found reasonable individual policies. Can we reimburse these people for what their new coverage will be tax-free? Under section 106 it appears that we can. Also, do we have to extend this offer to new employees going forward? We would only like to cover the employees that were taking advantage of this benefit on the date of cancellation.

    There was one 5500 filed, but there was no audit. Can we file an amended 5500 and include the audit without saying "Please come an fine us?"

    The principal business of "A" is performing management functions to B, C, D, & E. Company "A" is an S-Corp, while B,C,D, & E are exempt corporations under IRC 501©(3). Company A holds a health & life insurance contract w/ BCBS that provides beneifts for employees of A, B, & C. What type of arrangement is this considered to be(GIA, Multiple employer)? What type of 5500 filing is required? In the past there has been one 5500 filed as a single employer. Company A-3 participants Company B-over 100 Company C-less than 100
