Guest Peter Riggins Posted July 26, 2001 Posted July 26, 2001 When the employer (Plan Sponsor) changes mid-year because of an acquisition and the plan is retained by the new employer, do you use the name, address and EIN of the new employer to file a 5558? Also, if answer is yes, I assume you file the 5558 with the IRS office based on the location of the new employer.
RCK Posted July 26, 2001 Posted July 26, 2001 Assuming that the sponsor change took place in the middle of the plan year that you are now filing an extension for, I would file under the new employer's name and EIN. Then be sure to recognize the chaange in the 5500 when you file that. And keep the filing handy, because you will get questions. Note that all 5558 filings are now supposed to go to Ogden, UT.
