Guest jbaker Posted September 27, 2001 Posted September 27, 2001 The COBRA wording states the COBRA will/ may be terminated if the member BECOMES covered under another group insurance plan. Is the emphasis on becoming covered, or having other group coverage? If the member had secondary coverage through a spouse's group plan prior to and throughout the qualifying event, may COBRA be "denied" due to other existing group coverage: Or, since the member's intent was to have dual coverage, would the member have to BECOME covered under another group plan as a member to be COBRA terminated? Mary C Posted September 27, 2001 Posted September 27, 2001 COBRA may not be denied if the member has any other coverage prior to electing COBRA. After they have enrolled in COBRA coverage, COBRA may be ended early if they enroll in other group health care coverage that does not have a pre-existing condition limitiation.
GBurns Posted September 29, 2001 Posted September 29, 2001 Being eligible for other coverage is different from being enrolled in other coverage but it seems that you are saying that having other coverage is somehow different from enrolling in other coverage??? As far as I know you cannot have other coverage unless you are enrolled in it making the two one and the same. George D. QDROphile Posted September 29, 2001 Posted September 29, 2001 Odd as it may seem, if one has other coverage at the time, one can still elect and maintain COBRA continuation. If one does not have other coverage and elects COBRA continuation, getting other coverage later will allow the COBRA coverage to be terminated (unless the pre-existing condition limit exception applies).
