Guest mich823 Posted November 9, 2001 Posted November 9, 2001 DOES THE 6 MONTH EXTENSION FOR SPONSORS OF PLANS IN NEW YORK CITY APPLY TO BOTH THE DEPOSITING OF CONTRIBUTIONS AND THE FILING OF THE 5500 FORMS?
Guest merlin Posted November 9, 2001 Posted November 9, 2001 If you're referring to contributions necessary to satisfy the funding standard account for a defined benefit, money purchase,or target benfit plans, the answer is no. The IRS has said it doesn't have the authority to extend that due date.It can only be accomplished by legislative action, and Congress only extended the due date to 9/24/01. You might make it work for profit sharing plans.
MGB Posted November 9, 2001 Posted November 9, 2001 Congress did not extend anything. The IRS and PBGC are allowing contributions made by 9/24 to be included on the Schedule B for purposes of avoiding a funding deficiency and for calculating premiums. They do not have the authority to waive an excise tax for these late contributions. That is what they left for Congress to change, and it is not clear that they will.
